The Supreme Court decided to hear the case of Pärnu Hospital doctor Carmen Heinväli, who was convicted of criminal negligence after a baby was born with a permanent disability due to labor complications.
Heinväli's attorney, Raul Palmaru, says he wants the conviction overturned because, he argues, there was a lack of elements required to constitute criminal negligence.
In June, the Tallinn Circuit Court upheld the Pärnu County Court's verdict. Heinväli was sentenced to an eight-month suspended sentence with three years probation and was ordered to pay the equivalent of 1,500 euros.
The Pärnu County Court rejected the victim's counsel's bid for more than 60,000 euros in damages, and did not strip Heinväli of her doctor's license.
Heinväli was an on-duty physician in the case in question in early 2007. She was accused of failing to correctly evaluate the course of a patient's labor, as a result of which the health of both the mother and the newborn was severely harmed.
Heinväli maintains her innocence. The Supreme Court has yet to set a date for the first hearing.
